1. Agreement to Terms

By accessing or using NexDev's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

NexDev provides custom software development, consulting, and related technology services. The specific scope, deliverables, and terms for each project are defined in individual project agreements or statements of work.

3. Intellectual Property

Unless otherwise specified in a project agreement, all intellectual property rights in custom work developed for clients transfer to the client upon full payment. NexDev retains rights to general knowledge, tools, and frameworks developed independently.

4. Confidentiality

We treat all client information as confidential. We will not disclose project details, business information, or technical specifications to third parties without your written consent, except as required by law.

5. Limitation of Liability

NexDev's liability is limited to the fees paid for the specific services giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss.

6. Warranties

We warrant that our services will be performed in a professional manner consistent with industry standards. We provide a 90-day warranty period for bug fixes on delivered software, unless otherwise specified in the project agreement.

7. Governing Law

These terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in New York City.
